There was submitted the undernoted application for grant of a Private Hire Car Driver’s Licence. The applicant had been asked to appear personally for the first time:-

There was no appearance by or on behalf of Mr McLafferty, the applicant. The Convener proposed that the application be considered in Mr McLafferty’s absence. This was agreed unanimously. Mr Connell, the applicant, was invited into the meeting together with Sergeant Robertson, on behalf of the Chief Constable who had submitted an objection to the application. After consideration of all matters before the Board, the Board adjourned to allow members to consider this application. The meeting was reconvened and the Convener proposed that the application be granted for a period of one year. This was agreed unanimously.

There was no appearance by or on behalf of Mr Akinrinbola, the applicant. The Convener proposed that the application be considered in Mr Akinrinbola’s absence. This was agreed unanimously. After consideration of all matters before the Board, the Convener proposed that the application be granted for a period of one year. This was agreed unanimously.

Mr Akhtar, the applicant, was invited into the meeting together with Sergeant Robertson, on behalf of the Chief Constable who had submitted an objection to the application. After consideration of all matters before the Board, the Board adjourned to allow members to consider this application. The meeting was reconvened and the Convener proposed that the application be refused. This was agreed unanimously.

There was submitted the undernoted application for renewal of a Private Hire Car Driver’s Licence:-

The Managing Solicitor (Licensing) advised that this application had been granted under delegated authority for a period of two years.

DECIDED: That it be noted that this application had been granted under delegated authority for a period of two years.

The Board considered the possible suspension or revocation of the undernoted licence. The licence holder had been asked to appear personally for the first time together with Police Scotland:-

Licence holder: Rafal Bednarek

Mr Bednarek, the licence holder, was invited into the meeting together with Sergeant Robertson, on behalf of the Chief Constable. After consideration of all matters before the Board, the Managing Solicitor (Licensing) asked Mr Bednarek if he wished to address the Board on any action the Board might impose prior to any motions being made in relation to his Private Hire Car Driver’s Licence. Mr Bednarek then addressed the Board.

Following consideration of Mr Badnarek’s’ submission, the Board adjourned to allow members to consider the matter. The meeting was reconvened and the Convener proposed that Mr Bednarek’s Private Hire Car Driver’s Licence be suspended for the unexpired portion of the duration of the licence with immediate effect. This was agreed unanimously.

DECIDED: That Mr Bednarek’s Private Hire Car Driver’s Licence be suspended for the unexpired portion of the duration of the licence with immediate effect.

There was submitted the undernoted application for grant of a Temporary Public Entertainment Licence. The applicant had been asked to appear personally for the first time together with Police Scotland and the Council’s Director of Environment, Housing & Infrastructure who had submitted representations to the application:-

Operating hours: 7 days per week – 11.00 am to 1.00 am

Ms Patterson, on behalf of the applicant, and her representative, Mr McGowan, were invited into the meeting together Sergeant Robertson, on behalf of the Chief Constable and Mr Keenan, on behalf of the Council’s Director of Environment, Housing & Infrastructure who had submitted representations to the application. 

After consideration of all matters before the Board, the Board adjourned to allow members to consider this application. The meeting was reconvened and the Convener proposed that the application be granted subject to the usual standard conditions but that the operating hours be restricted to ‘Sunday to Thursday from 11.00 am to  12 midnight and from 11.00 am to 1.00am on Friday and Saturday’ and also subject to the additional conditions requested by Police Scotland in their letter of representation dated 19 August 2024 and the Council’s Director of Environment, Housing & Infrastructure dated 26 August 2024. This was agreed unanimously. 

DECIDED: That the application be granted subject to the usual standard conditions but that the operating hours be restricted to ‘Sunday to Thursday from 11.00 am to  12 midnight and from 11.00 am to 1.00am on Friday and Saturday’ and also subject to the additional conditions requested by Police Scotland in their letter of representation dated 19 August 2024 and the Council’s Director of Environment, Housing & Infrastructure dated 26 August 2024.
