Consideration was given to a Notice of Review submitted in respect of the Planning Application for the construction of 6 Class 4 Business (Office/Light Industry) units and associated parking at Ferguslie Community Business Park, 30 Mckenzie Street, Paisley (25/0035/PP).
The Independent Planning Adviser provided a summary of the proposal.
The Convener took the opportunity to remind members of the background to the Notice of Review and the decisions taken at the meeting of the LRB held on 17 June 2025.
The following materials were before members in relation to the Notice of Review:
(i) the Planning Authority’s submission, which included site history and National
and local policies and guidance to be considered;
(ii) the Notice of Review, together with supporting statements and productions submitted by the applicant;
(iii) information provided by the applicant in response to the Procedure Notice issued requesting written submissions in respect of specific issues; and
(iv) assessments of the applicant’s written submissions by persons suitably qualified to make those assessments.
The Convener confirmed that the LRB required to decide whether it had sufficient information before it to make a decision or whether further procedure was required to allow the LRB to determine LRB01.25/Planning Application 25/0035/PP.
Concerns were expressed in respect of the absence of relevant information to enable consideration of the proposal in connection with (i) ground conditions and stability (ii) the impact of any proposed lighting on neighbouring properties; and (iii) a car parking strategy/plan relating to the cars currently on site.
The independent Legal Adviser advised that in terms of the legislation the Notice of Review, which had been received on 19 May 2025, required to be determined within three months of being submitted and that in the event the LRB was of the opinion that it was unable to determine the application at this time due to insufficient information further information could be sought from the applicant. In the absence of a decision by 19 August 2025 the application would be deemed to have been refused, with the applicant having the right of appeal to the Scottish Ministers.
The Convener, in terms of Standing Order 59, formally proposed that the LRB did not have sufficient information before it to make a decision on the application at this time and that further procedure was required to allow the LRB to determine LRB01.25/Planning Application 22/0035/PP. It was proposed and agreed unanimously that consideration of the Notice of Review be continued and that the LRB direct that further written submissions be provided by the applicant providing clarification in respect of the issues detailed above.
DECIDED:
(a) That consideration of LRB01.25 (Planning Application 25/0035/PP) be continued and that the LRB direct that further written submissions be provided by the applicant providing clarification in respect of the issues detailed above; and
(b) That it be noted that in the absence of a decision by 19 August 2025 the application would be deemed to have been refused, with the applicant having the right of appeal to the Scottish Ministers.
