Due to the audio difficulties being experienced by Mr Nugent, the Convener proposed that consideration of the application be continued to later in the meeting to allow Mr Nugent time to address the issue. Mr Reid, the applicant joined the meeting. There was no appearance by or on behalf of Mr Connelly, the objector to the application. After consideration of all matters before the Board, the Board adjourned to allow members to consider this application. The meeting was reconvened and the Convener proposed that the application be granted for a period of three years. This was agreed unanimously.

Ms Lenty-Tyrell, the applicant and her letting agent representative, Mr Phelan, joined the meeting together with Ms Millar and Mr and Mrs McWilliam, who had submitted objections received outwith the statutory timescale to the application and Mr Armour, who represented Ms Millar.

On hearing the reasons for the lateness of the objections, the Convener proposed that the objections be taken into account when the application was being considered. This was agreed unanimously. 

After consideration of all matters before the Board, the Board adjourned to allow members to consider this application. The meeting was reconvened and the Convener proposed that the application be granted for a period of three years. This was agreed unanimously.

After consideration of all matters before the Board, the Convener proposed (a) that in relation to notification (i) no order be made thus allowing the procession to proceed and that the terms of standard condition 14 “That no band shall play before 8.00 am or later than 8.00 pm” be disapplied; and (b) that in relation to notification (ii) no order be made thus allowing the procession to proceed and that the terms of standard condition 14 “That no band shall play before 8.00 am or later than 8.00 pm” be disapplied. This was agreed unanimously.

The meeting was reconvened and the Convener proposed that Mr McLarnon’s application for variation of his Private Hire Car Operator’s Licence be granted to allow standard condition 1 of his licence to be amended to enable Mr McLarnon to continue to operate his present vehicle, registration number GF65 UNH for a period of one year from 4 September 2025, subject to the vehicle continuing to be tested at three-monthly intervals. This was agreed unanimously.

The meeting was reconvened and the Convener proposed (a) that Mr Sutherland’s application for variation of Private Hire Car Operator’s Licence PH1044 be granted to allow standard condition 1 of his licence to be amended to enable Mr Sutherland to continue to operate his present vehicle, registration number PJ15 MVR for a period of four months from 4 September 2025, subject to the vehicle continuing to be tested at three-monthly intervals; and (b) that Mr Sutherland’s application for variation of Private Hire Car Operator’s Licence PH1242 be granted to allow standard condition 1 of his licence to be amended to enable Mr Sutherland to continue to operate his present vehicle, registration number DY16 VUW for a period of four months from 4 September 2025, subject to the vehicle continuing to be tested at three-monthly intervals. This was agreed unanimously.

There was submitted a report by the Director of Finance & Resources seeking approval of an updated policy in relation to the licensing of short-term lets. The report intimated that the Council had a statutory duty to agree and publish a policy relating to Temporary Exemptions and to review this on a three-yearly basis. The Board first required to publish this policy prior to 1 October 2022 and now required to review this policy, and publish the new policy, prior to 1 October 2025.

DECIDED: That it be agreed that the terms of the draft revised short-term lets licensing policy, detailed at Appendix 2 of the report, be suitable for publication.
